Tax incentives
Anticipated recovery of the General Sales Tax (RERA IGV)
It allows projects with long pre-operational periods to recover the IGV on investments made in goods, services, construction contracts, and more, improving liquidity and strengthening the financial structure of the company. Law N° 31661: Temporary flexibility of the amount of investment to benefit from the regime. - Requirement: The investment commitment for a tourism project has been lowered from a minimum of USD 5 million to USD 2 million.
Exemption from General Sales Tax (18%)
For lodging and food services purchased in Peru by non-domiciled individuals, the General Sales Tax (18%) is exempt. In the case of food services, they must be provided within the same lodging establishment. This tax benefit enhances the competitiveness of tourism businesses by offering cost savings to international visitors.
Law N°. 27037: Law for the Promotion of Investment in the Amazon Region.
Taxpayers located in the Amazon region whose businesses focus on activities such as agriculture and tourism are eligible for reduced income tax rates on third-category income. Depending on the locality, the applicable rate is either 10 % or 5 %, providing significant tax incentives to promote investment and economic development in the region.
Law N° 31556: Law reducing VAT to 8 % for Hotels, Restaurants, and Tourist Accommodations (SMEs)
The measure is effective until December 31, 2024.
